Terms of Use: Websites

Any part of this Agreement is subject to change without notice.

This Agreement is made effective for all purposes in all respects as of 17-January-2026.

1. Introduction

These Terms & Conditions (“Agreement”) govern the services provided by Mike Pitches Media (“Provider”) to the client (“Client”). By engaging our services, the Client agrees to be bound by this Agreement. Our ethos is rooted in inclusivity, transparency, and safeguarding, ensuring that all projects reflect modern, ethical, and professional standards.

2. Scope of Services

Website Design: Bespoke, responsive websites designed to be accessible, inclusive, and aligned with the Client’s brand.
Maintenance: Ongoing updates, backups, security monitoring, accessibility checks, and technical support.
Domain Names: Registration, renewal, and management of domain names on behalf of the Client.
Email Services: Setup and management of domain-linked email accounts, including safeguarding workflows for child-focused or community projects.

3. Client Responsibilities

Provide accurate and timely content, approvals, and materials.
Ensure compliance with applicable laws, including GDPR and safeguarding requirements.
Maintain independent backups of critical data.
Promptly pay invoices as agreed.
Respect inclusivity and accessibility standards in supplied content.

4. Fees & Payment

Fees are outlined in the project proposal or service agreement.
Domain and email services may incur annual renewal fees.
Late payments may result in suspension of services until settled.
All fees are non-refundable once services have commenced, except where required by law.

5. Intellectual Property

The Client retains ownership of all content provided.
Mike Pitches Media retains ownership of proprietary tools, frameworks, or code not specifically developed for the Client.
Upon full payment, the Client is granted a license to use the completed website.
Branding and visual identity work is delivered with clear usage rights to avoid ambiguity.

6. Domain & Email Services

Domains are registered in the Client’s name where possible.
The Provider is not liable for domain loss due to late payment, late registration or registrar issues.
Email services are provided subject to third-party provider terms.
Safeguarding measures (e.g., parental consent workflows, DBS-compliant practices) are integrated where relevant.

7. Maintenance & Support

Maintenance covers technical updates, bug fixes, accessibility improvements, and security patches.
Support requests outside the agreed scope may incur additional fees.
The Provider is not responsible for downtime caused by third-party hosting providers.
Inclusive design and accessibility checks are part of ongoing maintenance.

8. Data Protection & Privacy

Mike Pitches Media processes personal data in accordance with GDPR and UK privacy law.
The Client is responsible for ensuring their website complies with privacy and cookie regulations.
The Provider may act as a data processor when handling Client data.
Safeguarding and consent management are prioritised for projects involving children or vulnerable groups.

9. Limitation of Liability

The Provider is not liable for indirect, incidental, or consequential damages.
Maximum liability is limited to the total fees paid by the Client in the preceding 12 months.
The Provider is not responsible for third-party failures (e.g., hosting, registrars, email providers).

10. Termination

Either party may terminate with written notice if the other breaches this Agreement.
Upon termination, outstanding fees remain payable, and services may be discontinued.
The Provider reserves the right to withdraw services if inclusivity, safeguarding, or legal compliance standards are breached.

11. Governing Law

This Agreement is governed by the laws of England and Wales.
Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
